Defective Medical Devices
There are many medical devices that can be implanted into the human body to extend, or improve the quality of life. Sometimes these devices are defective, improperly used or negligently inserted.

Qui Tam / Whistle-Blowers
The term "Qui Tam" has been around for centuries and it comes from a Latin phrase that means "he who brings an action for the king as well as himself." Qui Tam or Whistle-blower laws are used by the government as a means to combat fraud. This law is meant to persuade moral individuals to come forward when they become aware of fraudulent activities or false claims being committed against the government. Basically, Qui Tam affords a private citizen the right to file a lawsuit on behalf of the U.S. government under the Civil False Claims Act in an effort to recover losses caused by fraud against the government. The law is an incentive for civilians who know of individuals or companies making false claims for profit to come forward with information.

Whistleblowers in the Pharmaceutical Industry

Whistleblowers identify wrongdoings and stand up for their belief in what is right, despite enormous personal sacrifice and career risk.  Whistleblowers preserve the public welfare, ensure that companies engage in honest business practices, that they enact responsible policies, and that they remain accountable for their actions.  Most whistleblowers say that the feeling of fulfillment from knowing that lives have been saved as a result of their lawsuit coupled with the monetary compensation from the settlement made the process more than worth it.  Recoveries in qui tam cases that were pursued by the Department of Justice totaled $1.39 billion in 2003.  To date, whistleblowers rewards for bringing successful qui tam lawsuits total more than $1.2 billion.


 


Employees of pharmaceutical companies are starting to come forward and report illegal drug marketing, illegal kickbacks to doctors, unreported drug side effects, illegal pricing, and other transgressions.  In addition to helping the public and saving lives, financial compensation for pharmaceutical whistleblowers can be substantial.  Whistleblowers are often compensated in the millions of dollars under the U.S. False Claims Act, which allows private citizens to sue on behalf of the government and get a portion of awards in cases where firms defraud the government.

Workers' Compensation

The Workers' Compensation laws in Pennsylvania provide benefits to workers injured on the job or having an occupational disease; or to surviving dependents of workers killed on the job, or as a result of the job. The benefits are provided regardless of who was at fault in causing the injury, disease or death, and regardless of the previous physical condition of the employee. Under certain circumstances benefits may be available for injuries which occur traveling to or from work sites and for other work-related injuries, diseases and death, even away from the workplace.
